1. Introduction

Welcome to ATHENA Trading (“we,” “our,” or “the Platform”). By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations.

ATHENA Trading is a web-based trading interface that connects to the Bybit cryptocurrency exchange. We do not hold, custody, or have access to your funds. All trading occurs directly on Bybit infrastructure using your own API keys.

2. Acceptance of Terms

By using ATHENA Trading, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

You must be:

At least 18 years of age or the age of majority in your jurisdiction
Legally permitted to use cryptocurrency trading services in your country
Capable of forming a binding contract

3. Description of Service

ATHENA Trading provides:

3.1 Trading Interface

Web-based interface for Bybit cryptocurrency trading (also available as a desktop application for Windows and macOS)
Real-time market data, candlestick charts, and order book visualization via the Bybit API
Order placement and management tools (Market, Limit, and Conditional orders with Take Profit / Stop Loss)
Position monitoring, management, and margin mode switching (Isolated / Cross)
Support for Spot and Linear (USDT) perpetual futures trading
Symbol search and selection across all available Bybit trading pairs

3.2 AI-Powered Features

GPT-powered technical analysis across multiple timeframes (Scalp, Short-term, Mid-term, Long-term)
AI-generated trading recommendations including entry price, direction, Take Profit, and Stop Loss levels
Automatic order form population based on AI analysis
AI features are subject to daily usage limits and may be restricted by administrative controls

3.3 Platform Limitations

We are not a cryptocurrency exchange
We do not custody or hold your funds
We do not execute trades on your behalf — all orders are transmitted to the Bybit API
We are not a financial advisor or broker
AI-generated analysis is for informational purposes only and does not constitute financial advice

4. User Responsibilities

4.1 API Key Security

You are solely responsible for:

Generating and securing your Bybit API keys
Keeping your API keys confidential
Setting appropriate permissions on your API keys (Contract Trading, Spot Trading, and Wallet Transfer are required)
Immediately revoking compromised API keys via your Bybit account
Any trades executed using your API keys through our Platform

Do not share your API Secret with anyone, including us.

4.2 Trading Risks

You acknowledge that:

Cryptocurrency trading involves substantial risk of loss
You may lose your entire investment
Markets are highly volatile and unpredictable
Past performance does not guarantee future results
Leverage magnifies both gains and losses
AI recommendations may be inaccurate and should not be the sole basis for trading decisions
You are trading at your own risk

4.3 Compliance

You agree to:

Comply with all applicable laws in your jurisdiction
Pay all applicable taxes on your trading gains
Not use the Platform for money laundering or illegal activities
Not attempt to manipulate markets or engage in abusive trading practices

5. Account and Authentication

5.1 Authentication Method

ATHENA Trading uses Bybit API key-based authentication — there is no separate ATHENA account or password
You log in by providing your Bybit API Key and API Secret
Only Bybit accounts registered through the ATHENA referral link are eligible to use the Platform

5.2 Session Management

Your session will expire after periods of inactivity
You will be automatically logged out for security
Your API credentials are encrypted using AES-256-GCM encryption during your session
We never store your API Secret in plain text
API credentials are deleted immediately upon logout

6. Trading and Orders

6.1 Order Execution

Orders are transmitted directly to the Bybit API
We do not guarantee order execution or specific prices
Market conditions may affect order fills
Slippage may occur during high volatility

6.2 Order Types

The Platform supports:

Market Orders — executed at the current market price
Limit Orders — executed at a specified price
Conditional Orders — triggered at a specified price with configurable direction
Take Profit and Stop Loss — attached to positions or orders

6.3 Supported Markets

Spot Trading: Direct buy/sell of cryptocurrency pairs
Futures Trading (Linear): USDT-margined perpetual contracts with configurable leverage

6.4 Limitations

Order limits and restrictions are determined by Bybit’s instrument specifications
We implement rate limiting for API stability
Trading may be suspended during platform maintenance
Administrative feature controls may restrict access to specific markets, order types, or GPT features

7. Fees

7.1 Platform Fees

ATHENA Trading does not currently charge platform usage fees
This may change; any fee changes will be posted on the Platform

7.2 Exchange Fees

Bybit charges trading fees on all transactions
Fee structures are determined by Bybit
Fees are deducted directly from your Bybit account
Signing up through the ATHENA referral link provides a fee discount as offered by Bybit

8. Intellectual Property

8.1 Platform Ownership

ATHENA Trading and all related content, design, and code are our property
Our trademarks, logos, and brand are protected
You may not copy, modify, or redistribute our software

8.2 User License

We grant you a limited, non-exclusive, non-transferable license to:

Access and use the Platform for personal trading purposes
Use the web application and/or desktop application
You may not reverse engineer, decompile, or create derivative works from our software

9. Prohibited Activities

You may not:

Use the Platform for illegal activities
Attempt to gain unauthorized access to our systems
Interfere with the Platform’s operation or other users’ access
Use bots or scripts that violate API rate limits
Manipulate markets or engage in wash trading
Impersonate others or misrepresent your identity
Scrape or harvest data from the Platform
Use the Platform if you are in a restricted jurisdiction
Attempt to circumvent administrative feature controls or usage limits

10. Data and Privacy

10.1 Data Collection

We collect:

Trading activity logs (orders, positions, leverage changes)
Session information and login timestamps
Anonymous usage analytics

10.2 Data Storage

Your API credentials are encrypted using AES-256-GCM and stored only in your session — they are never permanently stored and are deleted immediately upon logout
Sessions are stored securely in our database
We retain logs for security and debugging purposes

We do not sell your data to third parties
We may share data when required by law
Bybit receives your API requests directly
OpenAI receives market data only (no personal information) for AI analysis features

11. Disclaimers and Limitations of Liability

11.1 No Warranties

The Platform is provided “as is” without warranties of any kind, express or implied.

We do not warrant that:

The Platform will be uninterrupted or error-free
Defects will be corrected
The Platform is free from viruses or harmful components
Market data will be accurate or timely
AI-generated analysis will be accurate or profitable

11.2 No Financial Advice

We do not provide financial, investment, or trading advice
AI-generated insights are for informational purposes only and may be inaccurate
You should consult a qualified financial advisor before making trading decisions
Any trading decisions are your sole responsibility

11.3 Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

Any trading losses or lost profits
Unauthorized access to your Bybit account
Bybit exchange outages or issues
Market volatility or price movements
Errors or delays in order execution
Loss of data or connectivity issues
Inaccurate AI analysis or recommendations
Any indirect, incidental, or consequential damages

Our total liability to you shall not exceed the total fees you have paid to us for use of the Platform.

12. Indemnification

You agree to indemnify and hold us harmless from:

Your use of the Platform
Your violation of these Terms
Your violation of any laws or regulations
Any claims arising from your trading activity
Unauthorized use of your API keys
Reliance on AI-generated trading recommendations

13. Third-Party Services

13.1 Bybit Exchange

Trading is conducted on Bybit infrastructure via the Bybit API
Bybit’s terms and conditions apply to all trades
We are not responsible for Bybit’s actions or omissions
Bybit may suspend or restrict your account independently

13.2 OpenAI (GPT Features)

AI analysis features use OpenAI’s API
OpenAI’s terms and policies apply
AI-generated content may be inaccurate or misleading
Do not rely solely on AI recommendations for trading decisions

14. Termination

14.1 By You

You may stop using the Platform at any time by:

Logging out (your encrypted API credentials are deleted immediately)
Revoking your Bybit API keys via the Bybit API management page

14.2 By Us

We may suspend or terminate your access if:

You violate these Terms
We suspect fraudulent or illegal activity
Required by law or regulatory authority
We discontinue the Platform

14.3 Effect of Termination

Upon termination:

Your access will be revoked
Your encrypted API credentials are deleted from your session on ATHENA
You must stop using the Platform
Sections that should survive will remain in effect
Your API keys remain active on your Bybit account — you should revoke them separately via the Bybit API management page if desired

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes should first be raised via email at support@athenatrading.io. If a dispute cannot be resolved informally, it shall be resolved through the courts or arbitration body of competent jurisdiction.

15.3 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes individually, not as a class action.

16. Changes to Terms

16.1 Modifications

We may modify these Terms at any time by:

Posting updated Terms on the Platform
Updating the “Last Updated” date

16.2 Acceptance

Continued use after changes constitutes acceptance of new Terms.

16.3 Right to Refuse

If you do not accept new Terms, you must stop using the Platform.

17. General Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and us.

17.2 Severability

If any provision is found invalid, the remainder continues in effect.

17.3 No Waiver

Our failure to enforce any right does not waive that right.

17.4 Assignment

You may not assign these Terms. We may assign them freely.

17.5 Force Majeure

We are not liable for delays or failures due to events beyond our control, including but not limited to exchange outages, network failures, or regulatory changes.

Cryptocurrency Trading Risks

Volatility: Prices can change dramatically in seconds
Leverage: Magnifies both profits and losses; positions may be liquidated
Liquidation: Your position may be forcibly closed in adverse market conditions
Loss of Capital: You can lose your entire investment
Market Risk: Markets can move against you without warning
Liquidity Risk: You may not be able to exit positions at desired prices

AI Analysis Risks

Inaccuracy: AI-generated analysis may be incorrect or misleading
Market Conditions: AI models cannot predict sudden market events or black swan scenarios
Not Financial Advice: AI recommendations are for informational purposes only
No Guarantee: Past AI accuracy does not guarantee future performance

Platform Risks

Technical Issues: Bugs, outages, or connectivity problems may occur
API Risks: Rate limits, errors, or delays in order transmission
Security Risks: Potential for unauthorized access despite encryption measures
User Error: Mistakes in order entry, leverage selection, or position management

Regulatory Risks

Legal Changes: Cryptocurrency regulations may change in your jurisdiction
Tax Obligations: You are responsible for all applicable taxes
Jurisdictional Issues: Services may not be available or legal everywhere

By using this Platform, you acknowledge you understand and accept these risks.
